Construction Accidents
The following article was written by Mr. Gelber and appeared in Western New York-area newspapers.
Construction work is among the most dangerous of all occupations. Only stringent safety practices, fall protection programs and proper management on the job site can help to prevent devastating construction accidents from injuring, disabling and killing workers. Unfortunately, not every job site has such safety practices and management. Construction sites are too often filled with dangerous conditions that can result in injuries to workers. Ladder and scaffold accidents are among the most common. Often these accidents could have been prevented had adequate and proper equipment been supplied or reasonable maintenance been done.
Obviously, many jobs require workers to work at considerable heights, which may require the use of fall protection devices and other safety equipment to prevent or break a fall. The use of barricades and warning signs where there are openings in roofs or other elevated walking surfaces is also necessary to prevent severe injuries on construction sites.
Many other conditions can also give rise to injuries and potential claims, including the use of dangerous tools. In addition, beams and other building materials can fall and injure workers, as can debris being discarded during demolition.
The failure to provide a fall protection system or other safety equipment for a construction site is or can be the responsibility of the owner, the general contractor or a subcontractor. Your rights under the New York State Labor Law must be carefully evaluated. Because the law of liability in this area is complex, it requires the assistance of experienced lawyers in this area of practice, such as those in our law firm.
If you suffer from an injury which occurred at a construction site, you and/or your family may have the right to pursue the responsible parties for your injuries. Our attorneys can evaluate your case and explain your legal rights.
